1. Who we are and what this covers
These terms are between you and Tidywork Studio LTD, company number 14278482, registered at Suite 201 Grangewood House, Oakwood Hill, Loughton, Essex, England, IG10 3TZ ("we", "us"). They apply to your use of TidyStagingAI™ at www.tidystaging.co.uk, a service that creates virtually staged images from photographs of empty rooms. By creating an account you agree to them. Please also read our privacy policy.
If you join through our invitation-only beta programme, our beta programme terms apply as well, and win if they conflict with these terms while you are in the beta.
2. Your account
You must give accurate information, keep your password secure and tell us if you think your account has been misused. You are responsible for what happens under your account. Enterprise accounts are set up with us under a separate Enterprise Agreement. An Enterprise account is made up of named seats: one Admin who manages the team and decides who can see which projects, and Stager seats for everyone else. A seat is for one named person and cannot be shared (see section 8 and our named user policy). Every seat must sign in with two steps (your password and a code from an authenticator app), and your work is recorded under your name, including on the activity record that comes with every download. The name and email on a seat cannot be changed by you: if someone leaves or a seat needs to change hands, ask us and we will make the change and issue the new person a temporary password. The number of seats, the price per seat, the minimum term and renewal are set out in your Enterprise Agreement; Enterprise usage is unlimited within our fair use policy. This applies to every account, not only Enterprise: each login is for one named person and must not be shared, and a login can only be signed in in one place at a time, so signing in somewhere new signs the login out everywhere else. An Agency plan includes one login, and you can add further named people as a paid add-on, up to the number shown in the app. We record where and on what device each login is used, and look at those records to check that logins are not being shared (see our named user policy and privacy policy).
3. Credits and payment
One credit stages one image. Plans, credit allowances and prices are shown in the app and on our website and may change; a change never affects credits you have already paid for. Payments are taken by our payment provider. Credits come in three kinds. Plan credits on a monthly Agency plan renew each month, and any you have not used roll over for one further month (rolled-over credits are used first and then expire). On an annual Agency plan the whole year's credits are given at the start as a single pool that you can use at any time until the plan renews. Top-up packs can only be bought by Agency subscribers; top-up credits are used after plan credits and expire 12 months after your latest top-up purchase. Subscriptions renew until you cancel, and you can cancel at any time from the billing page. Except where the law gives you a right to a refund, payments are non-refundable. Prices are shown without VAT, which is added where it applies. The price and credits of an annual plan are fixed for the year you have paid for.
When a credit is used. A credit is used when we generate an image for you, and every image we generate is shown to you for your approval in the same way. We check images automatically behind the scenes, but those checks are not a promise that an image is free of errors, and a credit is used whatever the outcome of the checks. The exceptions: no credit is used if the picture has a serious structural problem (a wall, door, doorway or window added, removed, moved or resized; a changed camera view; an invented recess, alcove or false wall; or a fixed feature such as a kitchen island, worktop, kitchen units or built-in added or removed), if our own checking could not be completed, or if a technical fault stopped us producing a picture at all.
Amends. You can ask for an amend to an image: paint up to six areas and describe each change, or describe the change in words, then press Generate once and all of it is applied together. The first amend on each image is free. Each further amend on that image uses one credit, however many areas it covers. Reopening an approved image does not give you another free amend.
Enterprise seats. An Enterprise subscription is charged per seat as set out in your Enterprise Agreement, not in credits. Usage is unlimited within our fair use policy, and amends are included. An Enterprise account also includes a small number of free view-only logins (named people who can see the work but cannot change or spend anything), and re-staging a room within seven days of its first staged image does not count towards the fair-use allowance.
Agency extra people. An extra person on an Agency plan is a named login that shares the account's credits and developments but cannot see billing or the activity record. Adding a person is charged straight away for the rest of the billing period. Stopping paying for a person lowers your price from your next invoice, with no refund for time already paid.
4. Your content and our output
You keep ownership of the photographs and files you upload, including any moodboard or reference you upload for a style, and you promise you have the right to use them and to have them processed as described in our privacy policy. That includes any copyright held by a photographer or a third party. You give us permission to store and process them, and to send them to our AI and image-generation providers, only to provide the service to you. You own the staged images we produce for you and may use them commercially, including in property marketing, subject to these terms. The law on copyright in computer-generated images is still developing, so we cannot promise that a staged image will have copyright protection.
If your photographs contain personal data, for example people or family photographs, you are responsible for having a lawful reason to upload them. We handle that data for you as our privacy policy describes.
Your library and storage. Every plan includes an amount of storage for your photographs, staged images and the other files you keep in your library, shown with your plan and on your billing page. We tell the account holder when the library reaches 80 per cent. When it is full we pause new uploads until space is freed or more is agreed with us; you can still view and download everything. We do not delete your content to make room, and we may offer extra space at a price we will tell you before you accept it.
5. Disclosing virtually staged images
Staged images are computer-generated and show furniture and decoration that is not in the property. When you use them in marketing, you must make clear that they are virtually staged, in line with the law, the CMA and Trading Standards guidance and the rules of the portals and bodies you advertise through. You must not use staged images in a way that misleads a buyer or tenant about the condition, size or fixtures of a property. This is your responsibility as the person publishing the images.
When you download images, we add a "Virtually staged" label to them by default. You can switch the label off, but you then remain responsible for making clear that the images are virtually staged wherever you use them.
6. Your responsibility for what you publish
You are the person publishing the images, so you are responsible for how they are used in your marketing. Before you publish or send a staged image, you must check it carefully against the real property, and you must not use it if it misrepresents the property's structure, size, layout, fixtures, condition, outlook or surroundings. You must follow the law that applies to property marketing, including the consumer protection rules in the Digital Markets, Competition and Consumers Act 2024, the CAP Code, and the rules of any portal or body you advertise through. We provide the service in good faith, and we expect you to market your properties with proper care and due diligence.
7. How we protect a property's structure, and reporting a problem
We have worked hard to keep a property's structure unchanged. The service is built with several safeguards: it is instructed to keep walls, windows, doors, ceilings, fixed fittings, flooring and the camera view exactly as photographed, it refuses requests to change the building itself, and every image goes through automatic quality checks. These safeguards reduce the risk of structural distortion, but the checks run behind the scenes, can be wrong in either direction, and are in addition to your own checks under section 6, not instead of them. Every image is shown to you for approval in the same way, and no AI system is perfect. We cannot promise that any image will be free of errors.
If you find any structural distortion or other inaccuracy in a staged image, do not publish it. Report it to the TidyStaging team as soon as possible using "Report a problem" on the image in the app, or by email to contact@tidyworkstudio.co.uk. We will look into it, replace the image where we can at no extra charge to you, and investigate and fix the underlying cause. Reporting a problem does not affect your legal rights.
8. Acceptable use
You must not upload content that is unlawful, that you have no right to use (including licensed or branded material, see section 9), or that contains people or private information without a lawful reason. You must not try to use the service to create misleading or harmful imagery, to remove or change structural features so a property looks different from how it is, to reverse-engineer or overload the service, or to share your login with anyone. Each seat on an Enterprise account is for one named person, who must use their own company email address and their own two-step sign-in. To protect this, we require two-step sign-in on Enterprise seats, record who does what and show your name against your activity, and may look at sign-in patterns (such as times, locations and devices) to detect sharing. If seats are shared we may charge for the extra seats from the date sharing started. We may refuse a request or suspend an account that breaks these rules.
9. Licensed, branded and third-party material
Staged images are meant to show a property furnished in a style. They are not meant to copy or imitate anything that belongs to someone else, and you must not use the service, or any moodboard, reference or request, to produce material that infringes anyone's copyright, trade mark, design right, image rights or other rights. Protected material can include, for example:
- logos, crests, badges, emblems, trade marks and brand names, including on products, packaging, clothing, equipment and signage;
- sports clubs, leagues and teams, and their kits, shirts, scarves, flags, banners, posters and merchandise, including players' names, numbers and likenesses;
- film, television, video game, comic, book, music and toy franchises, and their characters, logos, props, posters, album and book covers, and licensed bedding, wallpaper, toys and homeware;
- cartoon, mascot and brand characters, and close look-alikes of them;
- the names, faces, signatures and likenesses of real people, including celebrities, athletes, influencers and the people in family photographs;
- artworks, paintings, prints, photographs, murals, sculptures, posters and designs made by others, unless you hold the right to use them;
- distinctive designer furniture, lighting and homeware protected by design rights or trade marks, and close copies of branded items;
- distinctive patterns, prints, tartans, monograms and checks that belong to a designer, brand or mill;
- typefaces, fonts, slogans, taglines, lettering and signage;
- retail, hospitality, bank, airline, vehicle, food, drink, alcohol, tobacco, gambling and pharmaceutical brands and their packaging;
- app icons, screenshots, website and software interfaces, and the screens of devices;
- official or protected emblems and insignia, such as coats of arms, royal arms, armed forces, police, government, university, charity and religious badges, banknotes, passports and stamps;
- certification marks, awards and quality marks; and
- the text of books, magazines, newspapers, lyrics and sheet music.
We build safeguards against this. Our service is instructed not to reproduce protected marks and to refuse requests for them. If a moodboard or reference you upload shows protected material, for example official football club merchandise, we tell you, and we adapt it into close but original look-alikes in the same colours and design style, with no lettering, names, numbers or recognisable emblems, so that the protected material is not copied. The automatic checks are in addition to your own checks under section 6, not instead of them, they can be wrong in either direction, and a look-alike can still resemble the original more than we intend.
You must check every image before you publish it, and you must not publish an image that appears to show someone else's protected material. Please tell us if you see any. You must not try to get round the safeguards, for example by describing a protected item in other words or by changing its spelling. You are responsible for having the right to use anything you upload (see section 4). An adapted look-alike is not endorsed by, approved by or connected with the owner of the original, and you must not describe or sell it as official, licensed or branded merchandise or imply any connection with a brand, club, franchise or person. We may refuse, remove or limit anything that we believe infringes someone's rights, and we may suspend an account that repeatedly tries to produce it.
10. Quality and availability
AI-generated results vary. We check every image automatically and let you edit it (including your free amend) or approve it, but we do not promise that any image will be suitable for your purpose. We work to keep the service running but do not promise it will always be available or error-free.
11. Our liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or consequential loss, loss of profit, or loss of business, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. If you use the service as a consumer, your statutory rights are not affected, and the limits in this section apply only as far as the Consumer Rights Act 2015 allows.
Subject to the same exceptions, and in particular to sections 5, 6, 7 and 9: we are not liable for loss arising from you publishing or relying on an image that you have not checked as section 6 requires, or from a claim by a buyer, tenant, portal or authority about how a property was described or presented. If you use the service in the course of business, you agree to compensate us for claims made against us by third parties that arise from your use of staged images in breach of these terms.
12. Ending your account
You can stop using the service at any time and ask us to close your account by emailing us. We may suspend or close an account that breaks these terms, or on reasonable notice if we stop offering the service. Sections that by their nature should continue after the account ends will continue.
If your account is closed or your subscription ends, we keep your library for at least 90 days so you can download it. After that we may delete it, having told you by email first, and you can ask us to delete it sooner.
13. Changes to these terms
We may update these terms. If a change is significant we will tell you in the app or by email before it takes effect; continuing to use the service afterwards means you accept the updated terms.
14. White-label branding (Enterprise Plus)
An Enterprise account can add a white-label branded site, called Enterprise Plus. The only difference from Enterprise is the look: your colours, fonts and logo appear in the app for your team, and your name can appear next to ours. The service, the usage limits and every rule in these terms stay the same.
Enterprise Plus starts with a free trial. If you carry on after the trial, your price per seat goes up by the percentage we agreed with you and we charge a one-off setup fee, both starting from your next billing period and both set out in your Enterprise Agreement or in writing before they apply. If you do not carry on, your branding switches off, you go back to the standard look and your agreed Enterprise price, and nothing is charged for the trial.
You must have the right to use every name, logo and other item you give us for your branding, and it must not infringe anyone else's rights or mislead people. You allow us to show it in your branded site for as long as your branding is switched on. We can remove or refuse anything that breaks these terms, including section 9.
Our name always stays visible: “Powered by TidyStaging™” appears on every page of a branded site, and the “Virtually staged” label on downloads works as described in section 5. Branding does not change who provides the service or who is responsible for it, and it gives you no right to use TidyStaging™ or our logos beyond using the service.
15. Law and contact
These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction, although if you are a consumer in Scotland or Northern Ireland you may also bring a claim in your local courts. Questions: contact@tidyworkstudio.co.uk.
